What to Consider Before Submitting a Copyright Complaint

Before submitting a copyright complaint to us, please consider whether the use in question might qualify as fair use under applicable copyright law. Fair use allows limited use of copyrighted material without permission for purposes such as criticism, comment, news reporting, teaching, scholarship, or research.

If you are unsure whether the material constitutes infringement, we strongly recommend consulting with a qualified attorney before filing a notification.

Please note that a DMCA notification requires you to provide your personal information. If you are concerned about privacy, you may wish to appoint an authorized agent to submit the complaint on your behalf.

Notifications of Infringement

If you are a copyright owner or an authorized agent and believe that any content on Essaywala.com infringes your copyright, you may submit a written DMCA Notification to the contact details provided below. The Notification must fully comply with the DMCA requirements and include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work(s) claimed to have been infringed (or, if multiple works, a representative list).

Upon receipt of a valid and complete DMCA Notification, we will review it for compliance. If it meets the requirements, we may remove or disable access to the allegedly infringing material.

We will make a good faith effort to notify the affected user of any removal or restriction, including instructions on how to submit a counter-notification under the DMCA.

Please be aware that we reserve the right to take no action if a Notification does not fully comply with DMCA requirements.

This Policy does not limit any other legal remedies we may have regarding suspected infringement.

Counter-Notifications

If your content has been removed or access disabled in response to a DMCA Notification, and you believe it was removed in error or due to misidentification, you may submit a counter-notification in writing to the same contact details below. A valid counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that was removed or to which access was disabled, and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the Northern District of California), and that you will accept service of process from the person who provided the original Notification or their agent

Upon receipt of a valid counter-notification, we may forward it to the original complainant. If we do not receive notice within 10–14 business days that the original complainant is seeking a court order to restrain the allegedly infringing activity, we may restore the removed material.

Changes and Amendments

We reserve the right to modify this DMCA Policy at any time at our sole discretion. When changes are made, we will update the “last updated” date at the bottom of this page. We may also notify you through other means (such as email or site notices) at our discretion.

The revised Policy becomes effective immediately upon posting (or on the date specified), and your continued use of Essaywala.com after that date constitutes acceptance of the changes.
